Eligible entrants:

Entry is only open to Australian residents aged 18 years or over.

How to Enter:

To enter the Promotion, the entrant must complete the following steps during the Promotional Period:

• Use the EFC Official App or go to https://flickfooty.essendonfc.com.au; and
• Play the "Bombers Flick Footy" game and equal or beat the required Qualifying Game Score to receive an entry into the draw.

Any player that scores 10 points or more in a game (“Qualifying Game Score”) will receive an entry into the Weekly Draw associated with the time of entry. The draw entries for each Weekly Draw will not be entered into any subsequent Weekly Draw/s.

All valid entries submitted during the Promotional Period will be included in the Major Prize Draw.

Entries permitted:

Limit one (1) entry permitted per person for each Qualifying Game Score they obtain.

Additional provisions relating to the prizes:

The following additional conditions are applicable to the Major Prize Draw:
- Subject to the Australian Consumer Law, prize winners are responsible for ensuring the suitability of the prize for installation in their chosen location and for ensuring correct installation using a qualified installer.
- Subject to the Australian Consumer Law, prize winners will be responsible for all associated costs, including costs of installation, collection of the units from Essendon Football Club and delivery to their chosen location.
- Prize winners will be required to organise collection and delivery of the units from Essendon Football Club at their own cost.

The following additional conditions are applicable to all prizes including without limitation the Major Prize Draw:

• Prize winners will be required to organise any necessary flights, accommodation and/or transport costs incurred in the collection or use of any prize. For the avoidance of doubt the Essendon football Club is not responsible for any costs incurred by any prize winner in collecting and using any prize and the prize winner acknowledges that flights, accommodation and/or transportation costs are not included in any prizes

Any tickets awarded are subject to the event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to eject any winner and/or his/her companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

Winner notification:

The winners will be contacted by email and mobile within two (2) business days of the draw. The winners of all prizes will be published on the Essendon Football Club official website on the following dates:

All prize winners must accept their prize by phone or by email prior to the claim deadline as specified below.

Unclaimed Prizes:

Weekly Draw 2 and 6 prizes must be claimed by 5pm AEST 29/07/19. In the event of an unclaimed Weekly Draw 2 or 6 prize, the prize will be redrawn on 30/07/19 at 2pm AEST at Pro-Active Games Australia Pty Ltd t/a rubin8 (“rubin8”) , 55-61 Holdsworth Street, Cooparoo QLD 4151, Australia. Winners of this redraw will be notified by email and phone within two (2) business days of the redraw. The winners will be published on the EFC official website (essendonfc.com.au) by 02/08/19.

All remaining prizes must be claimed by 30/09/19 at 11:00 am AEST. In the event that any prize remains unclaimed, the prize will be redrawn on 30/09/19 at 12:00 pm AEST at Pro-Active Games Australia Pty Ltd t/a rubin8 (“rubin8”) , 55-61 Holdsworth Street, Cooparoo QLD 4151, Australia. The winners of any redrawn prizes with a value that exceeds $250.00 will be notified by email and mobile within two (2) business days of the redraw. The winners of any prizes with a value that exceeds $250.00 will also be notified publicly (and their details published) on the EFC official website (essendonfc.com.au) by 01/10/19.

1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. Valid and eligible entries will be accepted during the Promotional Period.
4. Employees and independent contractors (and their immediate family members) of the Promoter, the Australian Football League and any companies directly involved in the conduct of this Promotion, are ineligible to enter.
5. Draws:
   1. Weekly Prize Draws
      1. The draws will take place at rubin8, Unit 1, 55-61 Holdsworth Street, Coorparoo QLD 4151, Australia at 11:00 am AEST on 29/05/19, 05/06/19, 12/06/19, 19/06/19, 26/06/19 and 02/07/19 by computerised random selection. Entries open and close for each Weekly Prize Draw on the dates/times specified below. Non-winning entries in each Weekly Prize Draw will NOT be entered into any subsequent Weekly Prize Draw.

1. The first valid entry drawn in each Weekly Draw (excluding Weekly Draws 1 and 5) will win the prize for that draw as listed in the Schedule above.
2. The first valid entry drawn in Weekly Draw 1 will win Weekly Draw 1 Prize No. 1.  The second valid entry drawn in Weekly Draw 1 will win Weekly Draw 1 Prize No. 2.
3. The first valid entry drawn in Weekly Draw 5 will win Weekly Draw 5 Prize No. 1.  The second valid entry drawn in Weekly Draw 5 will win Weekly Draw 5 Prize No. 2.
2. Major Prize Draw:
   1. The Major Prize Draw will take place rubin8, Unit 1, 55-61 Holdsworth Street, Coorparoo QLD 4151, Australia at 11:00 am AEST on 05/07/19 using computerised random selection. All entries received throughout the Promotional Period will be entered into the Major Prize Draw.
   2. The first valid entry drawn in the Major Prize Draw will win the Major Prize.
   3. In the case any ineligible or invalid entries are drawn the Promoter may draw as many further entries as necessary in order to obtain a valid entry.
   4. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.

6. Any ancillary costs associated with redeeming the Bomber shop voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
7. Any tickets/passes awarded as part of a prize are subject to the event venue and ticket/pass terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to eject any winner and/or his/her companion or take any other action deemed necessary for any behaviour reasonably deemed to be inappropriate by the Promoter or event organiser, including but not limited to intoxication, whilst participating in any element of the prize.
8. The Essendon Football Club is not responsible for any prizes that are unclaimed due to the Essendon Football Club being unsuccessful in contacting any relevant prize winner.
9. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable at the designated time for the Event, they forfeit the prize and the Promoter is not obliged to substitute the prize.
10. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.
11. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
12. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
13. No entry fee is charged by the Promoter to enter the Promotion.
14. Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
15. Entrants' personal information will be collected by rubin8 and will be provided to the Promoter. Personal information will be stored on the Promoter's and rubin8’s databases. The Promoter may use this information for future marketing purposes regarding its, or approved third party’s products, including contacting the entrant electronically. Promoter/rubin8 are bound by the Australian Privacy Principles and the Privacy Act 1988 (Cth). Personal information will be dealt with in accordance with the Promoter/rubin8’s respective privacy policy which are located at www.essendonfc.com.au/privacy (for Essendon Football Club) and https://pagdig.blob.core.windows.net/rubin8/privacy/Privacy%20Policy%20rubin8.pdf (for rubin8). Each aforementioned privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter/rubin8 (as applicable) holds about them and how the entrant may complain about any potential breach by the Promoter/rubin8 (as applicable) of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. Promoter/rubin8 collect personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Promoter/rubin8 may transfer entrants' personal information to countries specified in their respective privacy policy. Entrants acknowledge the Promoter/rubin8 cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering this Promotion, entrants consent to overseas transfer on these terms and agree that Promoter/rubin8 are not liable for any such breach.
16. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
17. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
18. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
19. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
20. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
21. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
22. The Promoter (including its respective officers, employees and agents) and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
23. To the fullest extent permitted by law the Promoter does not provide any express or implied guarantees, warranties in relation to any prize and all such guarantees or warranties or representations are expressly excluded.
24. Where any guarantee, warranty, term or condition is implied or imposed in relation to these Conditions of Entry under the Australian Consumer Law or any other applicable legislation and cannot be excluded (a Non-Excludable Provision) and the Promoter is able to limit the prize winner’s remedy for a breach of the Non-Excludable Provision, the liability of the Promoter to the prize winner for breach of the Non-Excludable Provision is limited to one or more of the following at the Promoter’s option:
• in the case of goods, the replacement of the goods or the supply of equivalent good, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
• in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.
25. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
26. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
27. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
29. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
